This policy explains how Embroidery Works Limited collects, uses, stores and discloses personal information. We handle personal information in accordance with the Privacy Act 2020 and its information privacy principles.

1. What we collect

We collect personal information that is necessary for us to provide branding and decoration services and to run a trade account. Depending on how you deal with us, that may include:

When you enquire or apply for an account: your name, business name, email address, phone number, postal and delivery addresses, and anything else you choose to tell us in a message.

When you hold an account: the contact details of the people at your business who deal with us, your order history, artwork and files you send us, delivery addresses (including your customers’ addresses where we dispatch on your behalf), and account and payment records.

When you apply for credit: the information set out in our credit application, including company and director details, trade references and, where a personal guarantee is given, the guarantor’s details. How credit information is used is set out in clause 14 of our Terms & Conditions of Trade.

When you use this website: information you enter into our forms, and technical information such as your IP address, browser type and the pages you visit, recorded in our server logs to keep the site secure and working.

2. Information we collect from other people

Sometimes we receive personal information about you from someone other than you — for example, delivery details for your customers when you ask us to dispatch on your behalf, contact details passed on by a colleague at your business, or credit information from a credit reporting agency or trade referee.

Where that happens and the Privacy Act requires it, we will take reasonable steps to make sure you are told that we hold the information, what we are using it for, and how to contact us — unless you have already been told, or the information is publicly available.

3. Why we collect it

We use personal information to:

• quote for, produce and deliver work you have asked us to do;
• receive, check and book in stock sent to us by your suppliers;
• keep a record of jobs, artwork, colours and sizing so repeat orders match the original;
• set up and administer trade accounts, assess credit and collect payment;
• contact you about a job, a quote, or your account;
• keep this website and our systems secure, and diagnose faults;
• meet our legal and tax obligations.

We do not sell personal information, and we do not use it for marketing unrelated to our services.

4. Providing information is usually voluntary — but sometimes necessary

You do not have to give us personal information. However, if you do not provide what we ask for, we may not be able to open an account for you, quote accurately, produce your job, or deliver it to the right place.

5. Who we share it with

We disclose personal information only where it is necessary, including to:

couriers and freight companies — delivery names, addresses and contact numbers, so your job can be delivered;
garment and product suppliers — where we order stock on your behalf;
credit reporting agencies and trade referees — where you have applied for a credit account, as authorised in our Terms & Conditions of Trade;
our service providers — the companies that host our website and systems, send our email, and store files (see section 6);
professional advisers and debt recovery agents — where we need advice or need to recover an unpaid account;
anyone else where you have authorised it, or where the law requires or permits it.

6. Storage, and information held overseas

Personal information is held in our own systems and with service providers we engage to run them. Some of those providers store information outside New Zealand.

Our website and application are hosted on infrastructure located in the Asia-Pacific region. Files and images are stored with Cloudflare. Email is sent through Mailgun. Some artwork-processing features use services provided from overseas. Where we transfer personal information outside New Zealand, we take reasonable steps to satisfy ourselves that the recipient is required to protect it with safeguards comparable to those in the Privacy Act 2020.

We take reasonable technical and organisational steps to protect personal information against loss, misuse and unauthorised access. Access to customer information within our business is limited to people who need it to do their job.

7. How long we keep it

We keep personal information only as long as we need it for the purposes above, or for as long as we are required to keep it by law — for example, tax and company records. Job history, artwork and colour records are kept for as long as your account is open so that repeat orders can be matched to the original, and you can ask us to remove artwork you no longer want us to hold.

8. Accessing and correcting your information

You have the right to ask for a copy of the personal information we hold about you, and to ask us to correct it if it is wrong.

Email [email protected] or call +64 9 361 1159. We may need to confirm your identity first. We will respond as soon as we can, and within 20 working days as the Privacy Act requires. If we cannot correct information, we will attach a note of the correction you sought.

9. Cookies and analytics

This website uses cookies that are necessary for it to work — for example, to keep you signed in. We may also use analytics tools to understand how the site is used so we can improve it. Where analytics are in use, they are described here and you can block cookies in your browser settings, though parts of the site may not work properly if you do.

10. Privacy breaches

If a privacy breach occurs that has caused, or is likely to cause, serious harm, we will notify the Office of the Privacy Commissioner and the people affected, as the Privacy Act 2020 requires.

11. Complaints

If you are concerned about how we have handled your personal information, please contact us first — we would like the chance to put it right. If you are not satisfied with our response, you can complain to the Office of the Privacy Commissioner: privacy.org.nz, 0800 803 909.

12. Changes to this policy

We may update this policy from time to time. The current version is always the one published on this page.
